What does UK GDPR say about sending personal data abroad for testing?

UK GDPR restricts transfers of personal data to a "third country" unless the transfer is covered by adequacy regulations or appropriate safeguards such as the ICO's International Data Transfer Agreement (IDTA) or the UK Addendum to the EU SCCs, backed by a transfer risk assessment (ICO: international data transfers). Bangladesh is not covered by UK adequacy regulations, so a transfer there needs one of those safeguards. For QA, the practical answer is usually to avoid the transfer in the first place:

  • Test against synthetic data, not copies of real customers, so no personal data crosses the border.
  • Keep production data in your own UK or EU region, with testers deploying into an account you own rather than hosting anything.
  • Put an IDTA or the UK Addendum in place for any processing of personal data that cannot be avoided.
  • Sign a DPA defining the testers as processors acting on your instructions.

Does IR35 apply to an offshore QA service?

IR35, the off-payroll working rules, applies where a worker would be an employee if you engaged them directly through an intermediary (HMRC: understanding off-payroll working). A genuine business-to-business managed service, where the provider controls how the work is done, supplies its own people and equipment, and is paid for an outcome rather than for a person's time under your direction, is a different thing from a disguised employee. HMRC's own guidance notes that fully contracted-out services are treated as a service, not off-payroll working (HMRC: April 2021 changes to off-payroll working). The structure that keeps QA clearly a service:

  • You buy an outcome: tested releases, bug reports, a maintained suite, not a named person's hours.
  • Substitution is real. The provider decides who does the work.

In your repository, running in your CI, with bugs in your tracker.
